Second Griesa trial scheduled for November

Yuba County Judge Kathleen O'Connor on Friday scheduled a second jury trial for former Marysville towing company manager Joseph Patrick Griesa on charges of sexually assaulting an underage female employee.

The trial for Griesa, 44, will begin Nov. 10 with jury selection in O'Connor's court.

A jury in June failed to reach a verdict on the five felony charges, all involving the same girl, who is now 18. The charges are indecent exposure, intimidating a victim, sexual battery, false imprisonment and assault with a deadly weapon.

According to prosecutors, one of 12 jurors declined to convict Griesa on the charges. O'Connor declared a mistrial on the charges.

The jurors found Griesa not guilty of three other felony charges involving sexual assault of two other alleged victims at Mitchell's Towing Service, 1523 B St.

Griesa was found guilty of other felonies — concealing two young runaway girls from their parents and failure to pay taxes for two girls who worked for him. He was also found guilty of annoying or molesting a child — the first victim — by sending her sexual text messages.

Griesa has not been sentenced and is free on bail pending the new trial. O'Connor on Friday reminded Griesa that he can have no unsupervised contact with children under 18 and cannot possess guns.

O'Connor said Griesa has provided receipts showing he has sold his guns to a gun dealer.

Deputy District Attorney John Vacek said he expects the second trial to last four days after jurors are selected.

Griesa said Thursday in an interview that he will keep the same attorney, Charles Smith of Redwood City.
