Gang shooter makes plea deal
An 18-year-old Yuba City man will be sentenced Dec. 11 after pleading guilty to reduced charges stemming from a gang-related shooting June 9 on Melton Drive.
Mario Juan Franc Hernandez shot Sylvestre Gaeta, 20, once in the abdomen, temporarily paralyzing him. Hernandez is a member of the Norteños gang and Gaeta is a member of the rival Sureños, said Assistant District Attorney Fred Schroeder.
Gaeta “is doing pretty well now,” said Schroeder.
Hernandez originally was charged with attempted murder without premeditation after his July 10 arrest but pleaded guilty Friday in Sutter County Superior Court to battery causing great bodily injury. He will serve seven years in prison under the terms of a plea agreement, said Schroeder.
Schoeder called the case against Hernandez problematic because gang members who witnessed the shooting were unwilling to talk and neighbors feared doing so.
“It was a typical gang thing,” he said. “If it were a perfect case, he would have been given a life term.”
