Linda gang gunman sentenced to 13 years in prison

A Linda gang member was sentenced Monday to 13 years in prison for shooting at man in October, the Yuba County District Attorney's Office reported.

Patrick O'Day, 20, pleaded guilty to assault with a firearm and participating in a street gang. In exchange, prosecutors dropped an attempted murder charge, the district attorney's office said.

O'Day was sentenced in Yuba County Superior Court by visiting Judge James Dawson.

The victim's name has never been released to protect that person's safety.

Shots were fired Oct. 27 in the 1700 block of Hammonton-Smartsville Road during an argument between O'Day and two other men.

Nobody was hurt.

Two men, including the victim, were outside when O'Day pulled the weapon and threatened to kill both men, according to court documents.

O'Day then fired at least once at the victim and missed, records state.

Sheriff's deputies searched O'Day's home the following morning and recovered an unregistered handgun, believed to have been the weapon used in the shooting.

O'Day's relatively brief prior criminal history includes a 2009 Sutter County conviction for exhibiting a deadly weapon. O'Day was originally charged with criminal street gang participation in that case as well, but that charge was later dropped in court.
